Pleas before James Stewart, Judge of the McLean Circuit Court, at the Court House in Calhoon March 17, 1864

vs } Indictment
John Eirwin & Isaac Vertrees

The Grand Jury of McLean County, in the name & by the authority of the Commonwealth of Kentucky accuse John Eirwin & Issac Vertruse not being physicians of the Offence of giving, loaning & Selling Spiritious, Malt & Vinious liquors to the Slave of Another, not having at the time Said Slave under their Control, & Without the written Order of the Owner of Sd Slave or of the person having the legal Control of the Service, for the time being of Said Slave Committed as follows viz --

The Said John Eirwin & Isaac Vertruse, not being Physicians on the [ ] day of October 1861 Son [divers] days since, in the County afsd did give, loan & Sell Spiritous, Malt & Vinious Liquors to Henry a Slave, & the property Philip Hicks, and they Sd Eirwin & Vertruse, not having then & there Said Slave under their Controll

and not having then and there the Written Order of the Said Philip Hicks or of the person, Who then & there, had the equal control of the Service of Said Slave, against the Peace & dignity of the Commonwealth of Kentucky

This day Came as well the Atty for the Comth & defts in proper person and the law and facts of the prosicution were Submitted to the Court who after hearing the evidences and arguments of Counsel thereon, rendered a Joint Judgment

against the defendants of $50⁰⁰ and costs herein expended to which plff excepts. It is therefore adjudged by the Court, that the defendts make their fine to the Comth by the payment of $50⁰⁰ and the Costs herein expended and a Capias profine may issue & the defts may be taken & Co. And defendants moved the Court for a new trial which motion was Overruled by the Court, to which the defenant excpets.

I Louis L Moore clerk of the M^cLean Circuit Court do certify that the foregoing pages contain a full transcript of the writ of the Comth & Eirwin & Vertrees as of record in my office this 12^th day of April 1864
