To his Excelency B. Magoffin Govner of the Commonwealth of Kentucky,

The undersigned would respectfully represent that John. A. Ray has been convicted by the Pendleton circuit court for keeping a tipling house & find $60 -- and Sentenced by the court to thirty days imprisonment or until he pays the fine and is no in the Jail of the county under the sentance of the court they would respectfully ~~represent~~ State that from information the said Ray is a man of family which is entirely dependant upon his labor & efforts for a mantanance and he is a very poor man utterly unable to pay the fine against him= the purport of the Evidance upon the trial was to the effect following to wit=

The witness ~~[...]~~proved that in Dec last he sold or let hog drovers have a paint of whisky and at several other times Sold in Quantitys not less than ¹/₂ gallon one of the purchases there of Set the Judgg on Rays table and took a Dram of Spirits so purchased by the half gallon and no proof was before the court Showing he so Sold with the purpose that it should be drank upon his premises that purchasers were seen to Drink in his house of that they had purchased by these Quantities and under the Instructions of the court. the Jury returned a virdict against the undersigned at the present Oct term of Pendleton circuit court we the undersigned envoke,
the Clemency of the Execution in his behalf -- Especially since Mr Ray bears the character of a Sober industrious though unfortunat poor citizen and we pray your Excellency to remit said fine
