The Petitioner, A. G. Kelly, would respectively represent to The Governor of the Commonwealth of Kentucky that in the Hart Circuit Court on the [ ] day of [ ] he was indicted in said court charged with keeping a tippling house and at The April term of said Court, 1865, while he was absent & before he reached town, his attys, ~~[...] & [...]~~ were forced into the trial of the said charged and they having no witnesses present were compelled to waive a trial & let judgment be entered against Your petitioner, which they did in the absence of your petitioner, and under the circumstances then surrounding them, they could have done no better. Petitioner would further state that the said indictment was obtained by malicious influences,

We the undersigned do hereby state that A. G. Kelly is a good loyal citizen of Hart County and keeps & has always kept an orderly house and has invariably obeyed the laws of the state and Federal Government, so far as we know or believe and we have known him well for years & have personal knowledge of the foregoing facts -- and in our opinion this is a case in which it is proper, right & just to extend Executive clemency, and we respectfully ask that it be done.
