Capt. John J. Hawes recruited and now commands the 5^th Battery Ky. Vols. It was originally a twelve months battery -- but under an order from the War Department -- permitting that class of troops to re-enlist -- the men of his command, to the number of about one hundred, re-enlisted -- leaving the rest -- twenty-five or thirty -- still for the original term of service. That expires in September.

Capt. Hawes recruited from another twelve months organization- 49^th Regt. Ky. Vols. enough fmen for three years to fill his battery to the maximum, but because of the few men connected with his command, whose term of service will expire in a short time. his recruits cannot be mustered. If compatible with your rules, will you be kind enough to direct that this command be allowed to fill up to the maximum number, with three years men.
