The Commonwealth of Kentucky Plaintiff
against } Indictment for grand Larceny
Benjamin Singleton Defendant
At a Circuit Court held for Henderson County. Kentucky, on the 18^th day of December 1862.

"The defendant appeared in discharge of his ~~recognisance~~ bond, The Commonlth by her attorney appeared; & the defendant filed a plea of not guilty to the charge &^c and thereupon came a Jury viz. Wm J Marshall. A F. Parker, J. B. Clay. J H Lambert. A S Jones, Wm A McClanahan. Leonard Bentley, W B. Smith, D N Walden, Royal Utley, R H. Agnew, and John Tuell, who being sworn, and not being able to conclude the evidence were permitted to disperse until tomorrow morning at 10 Oclock having first received a charge from the Court [m] --

And afterwards on the 19^th of December 1862. "The defendant appeared in Court, and the Jury empannelled herein on a former day of this term appeared, and took their seats, & the argument of the counsel not being concluded were permitted to disperse until tomorrow. Morning 10 Oclock, under a charge from the Court[m]

And afterwards on the 20^th of December 1862:. "The Jury empannelled herein on a former day of this term appeared and took their seats; the argument of counsel being concluded, the Jury retired to their room and being unable to agree upon a verdict were discharged by the Court- Thereupon the defendant gave bond for his appearance in this Court on the 2^d day of its next June term to answer the charge in the indictment in the sum of $500- with Milton Young security-

And afterwards on the 12^th day of June 1863. "The plaintiff appeared by her attorney, and the defendant failing to appear in discharge of his bond, on motion of the Commonwealths attorney, the same is taken as forfeited, and ~~a Summons~~ this case is continued-"

We the undersigned were members of the Jury that tried Benj Singleton in Henderson Cir Court for Grand Larceny, & state that a majority of s^d jury were in favor of his acquittal -- We join in the request that the amount of the forfeited bond, signed by Milton Young decd. be remitted by your excellency
