To His Excelency the Govener of the Commonwealth of Kentucky, the undersigned would respectfully represent that some time in the year 1860, one John Todd was arrested and ~~tried~~Examined before the presiding Judge of the Ballard county court for Larceny, and [inlarged] by the said presiding Judge of the court afd upon Bail in the sum of Two Hundred and fifty Dollars, and the following gentlemen became sureties for the appearance of the said John Todd at the next Term of the Ballard Equity and criminal court to answer any indictment the Grand Jury might find against him, to wit Elijah Unsell, C. P. Ray and Jessee Hinkle. that the said John Todd fled the commonwealth to parts unknown. so that the said sureties have been wholy unable to surrender him so as to ~~ans~~ answer the indictment found by the Grand Jury, and whereas owing to the unsettled state of the country it would be an exceeding Hardship to inforce the Judgement of the Ballard Equity and criminal court against the said sureties, who would have omitted no reasonable efforts had times been such as to have favored ~~their~~ ~~efforts~~ them for the surrender of the said fugitive to the authorities therefore the undersigned would Respectfully ask your Excelency to remit the forfeiture, and protect the said Ray Unsell and Hinkle from the enforcement of the Judgement afd and as in duty bound your petitioners will ever pray &C
