H. C. Miller states on oath that at the fall term 1861 of the Nelson Circuit Court the time the recognisance was forfeited he started to Bardstown to court to appear in discharge of his recognizance, was taken sick on the road and was unable to get to Bardstown -- That at the following spring term of said court he was sick in bed and unable by reason of said sickness to get to Bardstown to court -- No summons had been served upon him, and he was not aware until some time afterwards that a writ had been served on his security Thomas Craycraft -- He states that he would have attended said court if his health had permitted -- That his health was very bad during the time of three terms of court and is still bad affiant being now confined to his bed

[Cloay] Lefler states on oath that she is the mother in-law of the above named H. C Miller that she knows of his being sick at the times above stated, she was with him during part of the time, and she knows the statements in his affidavit are correct
