Albany Ky July 2^d 1862,
To his Excellency B. Magoffin Gov &c

The undersigned your Petitioner would State that at the [ ] Term 18[ ] of the Clinton Circuit Court he was Indicted for Tippling and that at the ~~December~~ ^June^ Term 18601 of said Court he was fined for said offense the Sum of Sixty Dollars -- Your Petitioner States that he is an old man and at the time said Indictment was found against him, he ~~was~~ had a Distillery -- that he has no land. nor any means whereby to Support his family except his own work that he did not aim to violate the laws of Kentucky -- when he did -- He states that he is poor and has but verry little property and that he is unable to pay the fine -- He states that at the time the Judgment was rendered against him that he thought he could have paid it off before this time -- but has been and is now wholy unable to do so -- He asks the Executive to remit said fine and hopes it will be the last time he will ever have to make such a demand on the clemency of the Executive. This is the first time that he has ever called on any Governor to remit any fine. He states that it is the first time that he was ever found guilty of any offense by the laws of his country, that he is now 63 years old and has lived in Ky nearly forty years
