D^r Sir,

The Petition on the part of Moses Washburn herewith enclosed is signed only by a few, because it was thought under the circumstances unnessary, as the former one was numerously signed -- If you recollect Judge J. P. Fone, our mutual friend, presented in person the other petition when you remarked. I will hold the rod over him for 12 months, it will be of service to him -- at the end of which time if he conducts himself well, I probably will remit all allowed by law -- Washburn tells me that he has drank nothing since his trial, last March twelve months & indeed his appearance shows it I have virtually, as you know, acted in your present position & I cant call to mind a solatory case then presenting itself that justified more entirely, clemency and Executive interfearance than this -- The cost which is heavy & the attys. fee of $90 besides is of itself excessive -- The Shff. has returned "no property found" & he is now living at the cost of the Comw^th I am satisfied that the neighbors would be much gratified at your
remitting the fine -- & I have no hesitancy myself in saying that it would be right, & proper & charitable & a just exercise of your discretion to do so. --
