To his Excellency
Beriah Magoffin
Governor of the Commonwealth of Ky

we the undersigned members of the bar of Greenupsburg Ky -- and citizens of the County of Greenup, would respectfully represent, that William R. Smith of Greenup County, was Indicted -- by the Grand Jury of Greenup County ^for keeping a tipling house^ on on the [ ] day of May 1861 -- and the Defendent came into Court -- & confessed a judgement -- but with a promise of the Commonwealth's Atty R. H. Stanton that he would have the fine remited, by the Governor Except -- cost if possible -- the offense consisted of the Defendent having sold a qut of Liquor an on Election Day -- and probably a Drink or such a matter besides the quart -- Smith is a man in humble circumstances, with a large family to Support, and owing to the presssure of the times & scarcity of money -- a sale of his property would result in a great Sacrifice, to the Defendent Smith In view of all these facts -- we
would respectfully represent, that the circumstances by which this case is Surrounded, Should claim Executive clemency & interposition --

we therefore petition your Excellency -- to remit the fine Except cost
