More than a ^two^ years ago Isael Thomas was arrested in Mason County and held to bail in the sum of $500 -- His two brothers -- in law, living in Lewis County, Granville Busby and William Essex went his surety -- Thomas in order to indemnify Busby and Essex, also to pay Wadsworth his atto $50 fee gave them a mortgage on a small piece of ground in Lewis County -- Thomas did not appear, and the bond has been forfeited -- Since Thomas left it is ascertained that French Spurgin & al have claims and liens in the land. -- The land if clear of the liens would not bring more than enough to pay Comths atto his fees in the case and Wadsworth fee of $50 -- Essex has since died leaving a wife and child and a small estate_ Busby is a poor man with a very large family -- About a year ago, the County Judge, Sheriff & Clerk of the Circuit Court of Lewis County sent you a petition to release said
Busby and Essex -- You stayed the execution One year -- Busby and Essex paid the Comth^s atto his fees in the suit -- The time has expired and an execution may be issued at any time. I am satisfied that the parties ought to be released If the money has to be paid it will oppress them very much -- They are anxious to know what is to be done so they may sell the land and get the money they have already paid -- I hope you will look into the matter and give it your favorable consideration -- While at Frankfort I spoke to you about it. But you were so much engaged with other matters, that you could not give the matter your attention at that time I refer you to the petition of Busby and Essex and the County Judge, Sheriff &c heretofore sent you --
