The undersigned members of the jury that tried the case of the Commonwealth agst Charles Hawkins on a charge of permitting gambling recommend a remission of the fine against said Hawkins --

To His Excellency Governor B Magoffin

Charles A Hawkins respectfully states that on the 18^th February 1862 he was, by the judgment of the Franklin Circuit Court, fined $200 on a charge of suffering gaming on premises under his control. The circumstances out of which said charge grew are substantially as follows: Several gentleman living in Franklin County, being detained in town over night visited the coffeehouse of affiant and while there it was suggested that the party make a game of cards for the oysters. Mr Church his barkeeper positively interdicted all gambling. The visiters then remarked that they would take a game of Euchre for amusement, and went up stair with that understanding. They however, in violation of the injunction of Mr C, and without the knowledge or consent of affiant or his agent, played a game or so for the oysters which the party eat on the occasion. Affiant was not present and knew nothing of the circumstances. He never kept cards for sale, never permitted gambling of any description -- and in every way has in good faith, both personally and by positive instructions to his employees, endeavored to prevent gambling or other unlawful proceedings in his house.

All the foregoing facts were proven be on the trial and are true -- Affiant respectfully asks
for a remission of the Commonwealths portion of the fine --
