To his Excellency, Beriah Magoffin
Governor of the Commonwealth of Ky.

Your Petitioner, James Gatson, would respectfully represent, that at the present term, (Decr 1861) of the circuit court, held at Independence, Kenton Co Ky. a fine ^of $28^ was assessed against your Petitioner, for Standing his Jack under the following circumstances. Your Petitioner called at the county clerks office, at the usual time of the year. for procuring license, ~~and~~ found the clerk absent, and the office closed, left the amount necessary to pay for the license, with M^r James Rust; a citizen, and merchant residing at the county Seat requesting him to pay over the amount to the clerk on his return home, and receive his license therefor proceeded thereafter to Stand his Jack, under the full impression and belief that he had fully complied with all of the requirements of the law, that as soon as he ascertained that Rust had failed to take out license he immediately took out license himself, all of which facts appeared on the trial of the cause. We the jurors who -- tried the cause agree that the above represents the state of facts, and write in asking your Excellency to remit the Petitioners fine, being fully satisfied that his case is one --
requiring Executive interposition.
