To His Excellency Beriah Magoffin Govenor of Kentucky Greeting:

That whereas a judgment was rendered against one Joshua Baker for the sum of $35 fine on the Indictment in the Madison Circuit Court and your Petitioners became his surety for the payment of the same and whereas Your Excellency has seen proper to pen a former petition signed by many of the Citizens of Madison County. to stay and Respite said Judgment for twelve months and whereas since that time the said Joshua Baker has enlisted in the service of his Country and is now gallantly defending the Flag of the Union at great personal and Pecuniary sacrifice and under the circumstances aforementioned it having become impossible for the said Baker to discharge the said fine and Your Petitioner will be compelled to pay the same unless remitted by Your Excellency

He therefore prays that in consideration of the premises aforesaid You will remit said fine and so direct the officers of this Court

I certify that at the September Term 1854 an Indictment was found against Joshua Baker Hiram Baker and Marion Wilkerson upon the offense of Assault and that at the March Term 1857 a judgement was rendered against Joshua Baker for the sum of $35 in pursuance to the verdict of the Jury, and that upon the 16^th day of February 1861 a Capias Profine issued upon said Judgment and was repleived with Richard J White Security and that on the 6^th day of July 1861 a Respite was filed in the Clerks office of the Madison Circuit Court from which the Execution had issued and in which court said Judgment was rendered, which respite was dated 24^th June 1861 and ordering the fine to be respited Twelve months from the date hereof
