To His Excellency Beriah Magoffin
Governor of Kentucky,

Your Petitioner Joseph Vogt represents, that at the November Term (1860) of the city court of Louisville, he was fined fifty dollars for selling liquor to a minor William McCorkle was the witness against him-- he is about 19 years old and petitioner did not know but what said McCorkle was a man of full age, when he ~~gave him~~ took the drink of liquor, He denies that he sold the liquor to him but gave it to him. He had Employed J B Lancaster Esqr to defend the case for him, Mr Lancaster was sick in the County and unable to attend Court -- and petitioner was not present at the trial knowing that his attorney was sick and about, and he understood from his attorney that he had made arrangements with the Pros Attorney to continue all his cases for the term, therefore he did not not prepare for trial. Petitioner keeps a small Grocy on the corner of Chestnut & Jackson streets, and never Gave Liquor to said McCorkle, or any other young man before, nor has he ever before been charged with any similar offense He is poor, a man of large family, and unable to pay, the fine, the costs being as much now as he can pay-- He was Entirely ignorant of the law by which he was fined & promises to avoid such offense hereafter

Wherefore he asks a remission of the fine

I live next door neighbor to Mr Vogt & know him to be a good orderly citizen, and know that he is not in the habit of Giving or selling liquor in his grocery. He ~~has sent~~ Petition contains the truth & I join in his petition

The undersigned Citizens of Louisville unite in asking your Excellency to remit the fine against M^r Vogt. We know that Wm MCcorkle goes with a Crowd of vy bad boys, who went to the Grocey of Mr Vogt, and forcibly, took liquor, They have often put Mr Vogt in fear of the their disorderly & violent conduct -- as they have other good Citizens in the neighborhood

~~George~~ Jos Vogt states that Wm MCCorkle never paid him for any liquor. That MCCorkle came to his house with bad company, of whom he was afraid, and took the liquor, against ~~the~~ his consent of-- and he was afraid to resist them, as any other person in the neighborhood would have been who knows him & his company
