Augusta August 29^th 1861
To his Excellency Gov. MaGoffin

Your Petitioner Ferdinand Rhue would respectfully represent to your Excellency that at this August Term of the Bracken Circuit Court he was find upon his own confession sixty dollars for keeping a Tippling house. Your Petitioner would state that he is a German by birth and only been living in the united states about five years, unable to speak or understand the english language but imperfectly He states that he has a small vinyard in the County of Bracken near the city of Augusta, for the last two years his vines have been bearing, and he sold to some of his neighbors some of the wine the produce of his vinyard believing that he was doing nothing in violation of the law. And would state that so soon as he was notified that he could not sell to be drunk on the premises he forthwith and ever since has refused to sell. Your Petitioner commenced without anything looking to the bearing of his vines to pay his debts accruing until they have, if he is compelled to pay the fine, it will be to him a serious loss- and for an offence of which he was wholy ignorant. Your Petitioner asks that he may be ~~[...]~~ relieved from its payment in Justice to himself & family & as in duty bound &.

D sir -- Mr Rhue lives adjoining our town, and we are satisfied that he is selling wine the product of his vineyard acted in good faith- and intending to violate no law -- He is a poor but industrious German, so soon as he was advised that he could not sell his wine by the small, he refused to sell any more- and we are convinced he will strictly observe the law -- we hope you will remit his fine as an act of shear Justice --
