To his Excellency Beriah Magoffin Governer of Kentucky

The Petition of the undersigned, would respectfully represent that in April last he had an altercation with one Robert Garrey- in which angry words were used -- whereupon the Said Garrey Struck Petitioner twice with a heavy hickory kane and this before any ^still^ demonstration was made by Petitioner After w which Petitioner -- endeavored to Avenge the blows- when mutual friends interfered- and Petitioner did not lay his hand upon Garrey by reason of the interference Garrey and Petitioner were tried for a breach of the peace before E. Lusby a Justice of the Peace of Owen -- and a Jury impanneled who rendered a verdict fining both Garrey & Petitioner $9.25 ~~& cos~~ts Judgment was rendered on the verdict execution issued and is now in the hands of P. H. Smith marshall of the Town of Owenton -- Your Petitioner prays Executive Clemency and that Said fine be remitted & as in duty bound &c
