A petition will be presented to the Governor in a few days may be sent up by Willis B Matchen representative from Caldwell and Lyon -- asking the Governor to remit and release the sureties of Daniel B Calvert from an Appeal Bond executed by Daniel B Calvert to the Commonwealth for ($300) a Judgment rendered against him in the Caldwell Circuit Court on an Indictment and Charge of an Affray^" from which Calvert prayed and Obtained an appeal and executed Bond and the appeal has been twice dismissed in the Court of appeals for failure to file the record in 60 days" after the Bond was executed D.. B.. Calvert was Killed and his sureties failed to prosecute the appeal and after Dismissal -- in court of appeals I instituted suit against the sureties in the appeal Bond to recover the $300 and cost -- and I am now prose
citing a suit against them on the Bond and the Object of the petition is to release Calverts sureties in the appeal Bond I hope you will present if possible the Governor interposition and release of the Sureties in the Bond untill I can recover judgment on the Bond.. I do not like to be Chiseled out of my fees and Calverts sureties ought to pay the whole Bond and Cost -- Send me Copy of the Order dismissing the appeal the last time.. I have the first Order dismissing the appeal case D. B.. Calvert vs Commonwealth
