To His Excellency Beriah Magoffin

your Petitioner S. B. Rains would respectfully represent that on the [ ] day of January 1861 he was taken before S. D. Sutton Presiding Judge of the Whitley County Court and by him Judgment was rendered against your Petitioner for twenty five dollars for killing his own horse

Your Petitioner would further represent that at the time the horse was killed that he was so drunk that he does not recollect one think about the transaction but supposed he killed the horse or at least that was the proff upon the trial

Your Petitioner would further represent that he has lost the horse which was worth $75 -- and thinks it very ^hard^ that because he got drunk and went crazy and killed his own horse that he have a $25 -- fine to pay in addition to the loss of Horse which was great enough he is a very Poor man and has a large family Dependant upon him for their Support and it
presses him hard to keep his family something to eat these hard times and if made pay the aforesaid fine he fears they will Suffer

The premises considered the prayer of your Petitioner is that you remit said fine for which he will ever feel gratful and further promises to not get drunk and act the fool as he has this time
