To his Excellency Beriah Magoffin Governor of the Commonwealth of Kentucky

Your Petitioner D. A. Davis would respectfully represent that at the July Term 1859 of the Pulaski Circuit Court he was fined the sum of twenty five dollars for Gaming and that a capias for his body is now in the hands of the Sheriff. He says that the Indictment was procurred against him through malicious and revengeful feelings, He says that he Committed the offence for which he was indic^t~~ment~~. but that him and a few neighbors were playing in an out of the way ^place^ for amusemsent and not for profit. That the prosecutor became angry at one of the party and indicted the whole party to gratify his malice against one, He says he is a hard working man and supports his large family by his own labor and not by Gambling. He says he is poor and that to force the collection of this fine. would materially injure him more especial during the present financial crisis. That the wealthy are scarcely able at this time to pay their debts much ^less^ a poor man who has a large family dependant upon him for Support. He there fore prays yours excellency
either to remit said penalty or at least to give a Stay for twelve months,
