To his Excellency B. Magoffin Governer of Kentucky, Your petitioner E. L Coles respectfully states:

That about the first of July last your petitioner who ~~was~~is a citizen of Lexington Fayette county came to paris on a visit & put up at the Bourbon house in paris, & with some friends engaged in a game of cards with a stake of ten cents, it being for amusement alone -- It was a casual visit & a casual game, and he is in no sense of the word a gambler or addicted to gameing in any way --

Some malicious person got knowledge of the game, & got the Grand Jury to summon one of the gentlemen engaged, & forced him to be a witness, and at the July Term last of the Bourbon circuit court he was fined $20 in two cases, it being proved by the witness that the party was engaged before dinner & after dinner -- John Talbott & Capt Worley of Lexington were the other parties engaged in the 10 cent game afrs^d and the fines of said Talbott have been remitted. He prays for the remission of said fines --
