Davidson County

On this the 29^th day of June 1865 before me a Notary Public in and for the County and state aforesaid personally appeared T J Waggoner and made oath in due form of law that on the 17^th day of May 1865 John Davis colered was arrested by the civil authorities of Nashville on a charge of Larceny and on that on the 26^th day of May he had a trial before the recorder and was bound over to appear before the next term of the criminal court and gave bail in the sum of two hundred & fifty dollars for his appearance, and that said bond has been forfeited and according to telegram the said Davis is now under arrest by the civil authorities of Louisville Ky.

And he also made oath that he was the main witness for the state and that the following is the testimony he gave in on ^the^ trial

1^st That some days previous to said trial he caught John Davis & Alfred Harris carrying Sugar & Coffee amounting
in value to about Ten or Fifteen dollars, from the commercial Hotell. And that the same did not belong to them

I Andrew J. Fletcher secretary of state of the State of Tennessee do hereby certify that W. D. Roberts who has subscribed his name to the foregoing affidavit as Notary Public and has affixed his seal of office as such was a Notary Public of the County of Davidson at the time the same was subscribed and affixed and that his attestation is in due form of law
