At the November Term 1865 of the Caldwell Circuit Court a judgment was rendered in favor of the Commonwealth of Kentucky against A,, W,, M^cChesney for ($1500) as bail for W,, R,,. M^cChesney indicted for Murder and also a judgment rendered in favor of the Commonwealth of Kentucky against Alfred Beckner as bail for said W,, R,, M^cChesney ^for $300=^ indicted for robbery,, the answers of said A,, W,, M^cChesney and Beckner to Summons alledged that said W,, R,, M^cChesney was conscripted by one Captain Webster into the Rebel Army in Caldwell Co in august 1864 and carried to Alabama against his will and consent (see answer) A,, W,, M^cChesney and Alfred Beckner are good citizens and law abiding men Beckner is a poor man and M^cChesney is a man in Moderate circumstances and in the spring of 1865 was robbed of about ($1500) by a band of desperados at night at home and badly treated and abused by them and I have no idea it was by their consent that W,, R,, M^cChesney failed to appear and answer said indictments against him If said parties are forced to pay the full amount of said judgments to the Commonwealth it will be oppressive on them and
and as said A,, W,, M^cChesney and Alfred are each of them moral men and good citizens and have violated no law and are law abiding citizens,, I recommend to your excellency to examine into their applications and if consistent with the public good that you extend to them such executive clemency as their cases and circumstances seem to demand under all facts in their case
