P D Yeiser States that in the latter part of the year 1860 or first of 1861, he became bail in the Lyon circuit Court in the Sum of $[ ] for the appearance in that court for trial of [ ] Ballentine charged by indictment with malicious Stabbing -- at the time Ballentine was but a boy only 16 or 17 years old & a notably good boy at that decidedly loyal, was followed up & hunted & waylaid in the night time by a young man older than himself named Terril, a fight [ensued] in the night time & Ballentine Stabbed Terril not killing him & was indicted

Ballantine being poor, really loyal & his parents sober clean & respectable I went his bail to keep him out of jail -- In the Summer of 1861 when it became dangerous for Union men to stay in Lyon County the Young man Ballentine came and asked me if I would consent for him to leave until the next court & I did so & before the next court he joined an Illinois Regiment. I do not know the Number thereof, he has served faithfully ever since was in the Nashville fight under Genl Thomas a few months ago -- I hear since he is dead but cant find the proof -- during the war his family are scattered & I cant find where they live -- Now the atty for the com^l. is trying to get a Judgment against me & I wish a pardon so as to prevent it
I say positively and emphatically Ballantine never placed in my hand or under my control either directly or indirectly money, property or anything else to indeminify me in the bail that the same is about to prove a total loss to me I have not even rec^d one cent in the way of a fee or otherwise from Ballantine
