Stephen Clark being in custody charged with the offense of larceny, and being admitted to bail in the sum of Three hundred dollars, now, We, C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress & W. H Herman of Muhlenberg County Kentucky, hereby undertake that we the above named Stephen Clark will appear in the Muhlenberg Circuit Court on the first day of its next November term to answer said charge and will at all times render himself amenable to the orders and process of said Court in the prosecution of said charge, and if convicted, will render himself in execution thereof, or, if, he shall fail to perform either of these conditions, that we will pay to the Commonwealth of Kentucky the sum of three hundred dollars. Witness our hands this 27^th day of September 1864.

On motion of the atty for the Commlth, the defendant Clark having been called and failing to appear in the discharge of his bail bond entered into on the 27^th day of September 1864 in the sum of three hundred dollars, It is therefore adjudged by the court that said bail bond be and is hereby declared forfeited, and
that a summons is awarded against C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress and W. H. Herman, returnable to the first day of the next term of this Court, to show cause if any they can why Judgment shall not be rendered against them for three hundred dollars as the sureties of said Stephen Clark on said forfeited bail bond, for the appearance of the said Stephen Clark in this court on the first day of its present term and further to do &c --

upon which summons issued & was returned by the sheriff of Muhlenberg County duly executed on the said C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress, and W. H. Herman on the 18^th of April 1865,

The defendants C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress, & W. H. Herman having been duly summoned and failing to answer, It is adjudged by the court that the Commonwealth of Kentucky recover of the defendants C. L. M^cCoun, T. E. Fulkerson, J. V. Fentress & W. H. Herman the sum of three hundred dollars with interest thereon at the rate of 6 per cent from this date, and the costs of this prosecution and that execution may issue thereon --
