This Affiant W^m I Johnston says that he is and has been the owner of a large number of vacant lots — lying in the city of Covington. That he is not informed by the indictment against him (No 883) upon what lot or parcel of ground the "pond of putrid, filthy, noxious and stagnant water" was allowed and permitted by him to accumulate.

He further says that he is not, nor, was he at the ~~finding~~ ^time specified in^ of this said indictment, or since, the owner of any such lot of ground upon which, by any unlawful act done or permitted by him, such pond or accumulation was collected, causing such nuisance as charged in said indictment. He says he was at the former trial, and is now, prepared, to make proof of the foregoing statements.
