The Grand Jury of this Court on the 21^st day of April 18654 returned an Indictment, against Jos Hemming, for Keeping a Ddisorderly House, upon which summons were issued and executed on the Defendant, Whereupon on the 17^th day of May 1864. the case coming on to be heard and the Defendant although called, came not, a Jury thereupon was had to try the case, who found the Defendant guilty and assessed his fine at $100, and on motion of the Comth's Atty a Capias Prof was issued forthwith against the Defen^t for said fine and costs which was replevied by the Defendant on the 10^th of June thereafter, upon said replevin bond a Fi. Fa. issued on the 22^nd of October following, whereupon the Defendant paid the fees and costs in the case, amounting to $51⁵⁰, the balance remaining unpaid, the Marshal of this Court, on the 24^th day of December 1864, levied on the house and lot belonging to the Defendant, which ~~forfeiture~~ property is yet in the hands of the Marshal, not having been sold for want of bidders thereon, when exposed for sale
