Campbellsville Dec 13^th 1864
To, the Hon Thomas. E. Bramlette Gov of the Commonwealth of Kentucky,

your petitioners John Baily and John Faulkner State that in the year 1862 one Chas, O, P Smith was arrested in Taylor county and tried before an Examing court upon the charge of making and Selling Bowie knifes to Slaves; Said Smith was Sent on to further trial; & committed to Jail and your petitioners Baily & Faulkner went on his bond & bailed him out; Soon after that he was bailed; out; he was again arrested on the charge of horse Stealing committed to Jail and remained there until ~~his~~ ~~trial~~ ~~was had for~~ the next term of the Taylor Circuit Court, when the Grand Jury failed to indict him for the latter offense, He was acquitted ofor that charge And your petitioners were advised ^by the Jailor^ and verily Believed that the presence of Said Smith in the Jail ~~and his being present all the time during his~~ ~~trial~~ during nearly the whole term of the court, ~~for~~ on the charge of horse stealing was a Sufficient deliverying up of Said Smith on their part to release them from his bond and in fact thought that Said Smith was being tried for both offenses at that term of the court; and being told by the Jailor and others as above Stated that they were released they paid no further attention to the matter
and thus at the March Term of the Taylor Circuit Court 1864 their bond was forfeited and at the Sept Term of Said court /64 Execution issued, ~~on which~~The amount of Said bond ~~was~~ is $1 50,00 and under all the circumstances your petitioners think that your Excellincy Ought to remit Said fine for which they prey &

John Spurling States that he was Jailor of Taylor county at the time Spoken of in the foregoing petition and that he did tell Said Faulkner that he thought he ^Faulkner & Baily^ was released from Said Bond & and that the facts Stated in the foregoing petition are true
