To His Excellency Tho^s. E. Bramlette Governor of Kentucky

Your petitioner Lewis Wallascheck would respectfully represent that at the present, "Octo," Term 1864 -- of the Franklin Circuit Court he was fined the sum of $200 00 for permitting "gaming" in his house, He would represent the facts in the cause to be as follows -- in Oct, 1863, he set up in the back room of his small "confectionary" establishment in Frankfort, a "Pigeon Hole" Table, That the object & design of said table was to draw "Custom" to his establishment, several others ingaged in a similar business, having tables of this kind in their establishments, That the purpose of this table was to afford amusement to those who might frequent his house, That he charged for the priviledge of playing each game upon said table, the players five cents each, & gave to each a check as follows, ("good for 5 cts in refreshments L Wallaschick") which said check entitled the holder to 5 cts worth of refreshments at his Establishment, That the running of the tables only operated to his benefit on this, it enabled him to sell more goods -- That he not only prohibited any and all betting
by an express prohibition on his part, but he had at the end of his table a lettered card -- reading as follows. "No betting allowed upon this table," He further states that he is a poor man with a family to support & that the only means that he has of doing so are derived from his profits out of his small "Confectionary Establishment", that he is entirely unable to pay the fine imposed upon him & if Compelled to do so, he would have to sacrifice his little stock of goods & thereby deprive himself of the means of supporting his family -- or be confined in the County jail. Wherefore he prays that so much of said fine be remitted, as is not due & belonging to the officers Concerned,
