CIRCUIT COURT.
THE COMMONWEALTH OF KENTUCKY, Plaintiff,
AGAINST } Indictment for Assault & Battery
Thomas Ruth Defendant.

The Grand Jury of Owen county, in the name and by the authority of the Commonwealth of Kentucky, accuse Thomas Ruth of the offense of Assault & Battery committed as follows, viz:

The said Thomas Ruth, in the county, circuit, and State aforesaid, on the 28^th day of April, 1864, did unlawfully assault beat and bruise and then and then and there unlawfully shoot at Jeptha Estes with a loaded gun loaded with powder & Shot & did then and there unlawfully assault beat & bruise the wife & daughter of said Jeptha Estes -- to wit Cordelia Estes and Miss Frances Estes -- they being then & there in the dwelling House of the said Jeptha Estes and under his control & protection -- and the said Thomas Ruth did then and there unlawfully and in a violent & forcible manner bust open the door and enter the dwelling house of the said Jeptha Estes and set said dwelling house on fire without consuming said house and all this in the night time contrary to the statute in such case made and provided, and against the peace and dignity of the Commonwealth of Kentucky.
