Malcomb ^C^ M^cFaddin

"The Commonwealths attorney appeared, and Malcom C M^cFadden with J T Savage and T Yateman Clark having entered into a recognizance before D T Hays police Judge of the town of Hopkinsville on the 22 day of July 1862, in the sum of Two Hundred dollars for the appearance of said M^cFaddin in this court to answer for stabbing W^m Withy and said McFaddin not so appearing although called -- It is ordered that said Recognizance be forfeited, and it is further ordered that a summons he issued thereon against said M^cFaddin J T Savage & T Y Clark to appear in this court on the 1^st day of its next September Term to show cause why execution should not be issued for the amount of said Recognizance, and a Bench warrant is awarded herein bail fixed in the Sum of $200"

The Recognizance executed by the said J T Savage & T Yateman Clark for the appearance of the said M^cFaddin is as follows viz:

"Police Judges Court
Hopkinsville Christian County Kentucky

Malcom C M^cFaddin in custody charged with the offense of stabbing William Withy in a sudden affray in the town of Hopkinsville on the 21^st day of July 1862. and being admitted to bail in the sum of Two Hundred Dollars

Now we J T Savage & T Yateman Clark of Christian County Kentucky hereby undertake that the above named Malcom C M^cFaddin will appear in the Christian Circuit Court on the first day of its next September term to answer ^said^ charge, and will at all times render himself amenable to the orders & process of said Court in the prosecution of said charge and if convicted will render himself in execution thereof- or if he shall fail to perform either of these conditions, that we will pay to the Commonwealth of Kentucky the Sum of Two Hundred Dollars witness our hands this 22^d day of July 1862
