Sir,

I have the honor to acknowledge the receipt of your letter of the 25^th ultimo, asking the reason of the stoppage of pay against Captain J. M. Hewitt, 2nd Kentucky Battery.

In reply, I am directed to inform you, that Captain Hewitt is charged with retaining in his possession a commission issued by the Governor of the state to Private John W. Walls, as 1^st Lieutenant in the Battery, and refusing to deliver the same, thereby depriving Private Walls of his muster into
service as a commissioned officer

The case has been referred to the proper Commanding General, and is now under consideration.
